1. Purpose

These Terms of Use define the conditions for accessing and using the Ekydi platform, made available to schools, municipalities, or associations for managing extracurricular activity registrations.

2. Definitions

• Platform: the Ekydi software interface accessible from a personalized URL (white label).
• Publisher: Nuben LTD, publisher of the solution.
• User: any person (parent, legal guardian or administrative staff) accessing the platform.
• Client: the institution or organization (school, association, etc.) using the platform as part of its own operations.

3. Service access

Access to the platform is free for parents. Access is subject to an existing contractual relationship between the client and the publisher.

4. User obligations

Users agree to:

• Provide accurate information during registration.
• Not impersonate a third party.
• Not use the platform for fraudulent or illegal purposes.

5. Intellectual property

The Ekydi platform, its name, structure, design and features are the exclusive property of Nuben LTD. Any reproduction or use without authorization is prohibited.

6. Personal data

Personal data collected is processed in accordance with the GDPR. It is stored on servers located in Ireland, via the Heroku EU (Salesforce EMEA) infrastructure, and is not transferred outside the European Union.
The user may request deletion of their data at any time by contacting the publication director.

7. Responsibilities

Content published on the platform (including proposed activities, pricing, terms) is the responsibility of the client (school, association, etc.).
The publisher (Nuben LTD) cannot be held liable in the event of a dispute relating to content, cancellations or external payments.

8. Use on behalf of third parties

The client may use the Platform on behalf of a third party (e.g. a school, association or any other organization), provided that it:

• has obtained the prior authorization of this third party,
• ensures, in its own name, the fulfillment of all obligations set out in these Terms,
• and assumes sole responsibility for the use of the Platform, including the content published and compliance with applicable legal and regulatory provisions (in particular with regard to the protection of personal data).

In this context, the publisher has no direct contractual relationship with the third party and incurs no liability towards it. The third party has no rights or direct recourse against the publisher.

9. Hosting

The Ekydi platform is hosted on Heroku Europe servers located in Ireland, operated by Salesforce.com EMEA Limited. Data is stored within the European Union and protected according to high security standards.

10. Changes to the Terms

These Terms may be modified at any time. Users will be informed of changes via the platform.

11. Governing law

These terms are governed by Mauritian law. In the event of a dispute, exclusive jurisdiction is assigned to the courts at the registered office of NUBEN LTD, unless otherwise provided by law.
